Merrick Garland is set to make Supreme Court history this week for waiting the longest to be confirmed for the job to Justice.
President Obama nominated the Harvard grad back in March, after justice Antonin Scalia passed away.
The senate republicans have refused to give Garland a hearing.
The senate is now on summer recess until Labor Day.
