PITTSFIELD, Mass. (AP) — A 76-year-old Pittsfield man has been sentenced to two years in jail for sexually assaulting a young girl the day before her seventh birthday.

The Berkshire Eagle reports that Wayne Ovitt Sr. was sentenced this week after pleading guilty to indecent assault and battery on a child, open and gross lewdness, and witness intimidation.

The assault occurred in October 2014 when Ovitt was 74.

Prosecutors say Ovitt told the victim not to tell anyone, but the girl told her mother the next day.

Ovitt’s attorney said the assault occurred due to delirium brought on by a change in pain medication, but stressed that did not excuse the crimes. She asked for a more lenient sentence and said her client is remorseful.
