(NBC) — A man convicted of rape in Colorado will not serve any time in prison.
Austin Wilkerson, 22, was convicted in May for raping a fellow student at the University of Colorado-Boulder in 2014.
According to court documents, Wilkerson assaulted an intoxicated victim while she appeared to be asleep.
Instead of spending time in prison, Wilkerson will spend two years in a work-release program and will be allowed to leave the county jail each day for work or school.
His sentence will be followed by 20 years of probation.
Colorado’s attorney general says she is concerned about the light sentence.
“I have a genuine concern for what seems to be now a pattern in sentencing in sex assault cases where the viewpoint and the impact on the perpetrator seems to be taking precedence over what has happened to the victim,” said Attorney General Cynthia Coffman.
“We’re saying that that perpetrator’s future and life has more value to our society than that of the victim. And I think that is wrong.”
