HARTFORD, Conn. (AP) — Connecticut’s Supreme Court has granted visitation rights to a set of grandparents over the wishes of the child’s father.
The court on Thursday upheld the ruling of a lower court judge, who found that denying visitation would cause the child real harm.
The father, James Gavis, of Mansfield, had terminated visitation with the grandparents shortly after the child’s mother died.
He argued the court was violating his rights because the grandparents would not abide by his wishes to keep the child away from an aunt.
The high court found that while judges must give special weight to the wishes of a parent, they are not bound by those wishes if the parent is not acting in good faith.
Messages were left seeking comment from the attorneys in the case.
