It was last January when Laine signed on the dotted line. The health club wasn't open but she was promised it would be up and running in 30 days. Now a whole year later, nothing. Laine Carter, gym member"The phone number has been disconnected." At least Bill's new gym existed, but the club's manager insisted he had to pay by credit card. Bill Mitchell, gym member"I said cash isn't good? Is this America or what?" State consumer officials told us they constantly get complaints about health clubs and gyms. Undersecretary Dan Crane, MA Consumer Affairs and Business Regulation"I think part of it is probably the consumers are not as educated as they should be, or as assertive as they should be." So hey, exercise your rights, and here's exactly how. Laine's health club? The one that took her money and never opened? Turns out her answer might be here in the Secretary of State's office. We found brand new health clubs must file a big money bond, like a deposit. All that money should be waiting to pay back disappointed customers. As for some 'no cash' policy — no way. Credit cards may make billing easier for health clubs, but if you want to fork over the green they have to take it. Hank Phillippi Ryan, Investigative Reporter"If they refuse to take your cash, what should you say?" Undersecretary Dan Crane, MA Consumer Affairs and Business Regulation"Well, last time I checked and I looked at the dollar bill it says good for all debts public or private, and so they have to take cash." And listen, health clubs cannot make you pay a year in advance. Just say no. They can require a monthly fee, but Lori even after she canceled her membership, the club took those fees from her bank account! Lori, gym member"I feel ripped off." She complained to the gym, but listen Lori in billing disputes there may be a better way. Go directly to the credit card company and shut off the payments. And even if you sign a health club contract, MA law says you have three days to change your mind. So don't let anyone strong arm you into making a mistake. Hank Phillippi Ryan, Investigative Reporter"And here's a new year's secret. In this economic climate gyms are eager to sign new members, so don't be afraid to negotiate! You might be able to work out a deal."
