John and Marian Burbine appear in court for child porn

WOBURN, Mass. (WHDH) — Lawyers for John and Marian Burbine say police illegally found thousands of child pornography pictures on the couple's home computer, and are trying to get damaging evidence thrown out.

A computer investigator for the district attorney described the unbelievably large amount of child pornography she says she found on computers when police executed a search warrant at the couple's Wakefield home last year.

“There are different calculators to approximate the media size and I believe when I did the approximation it was approximately 32 miles high,” said Melissa Marino, digital evidence investigator.

John Burbine is charged with 100 counts related to rape and sexual abuse of children and child pornography.

The alleged victims were several children in the care of Marian Burbine's Wakefield Day Care Center.

Marian Burbine is charged with six counts of wreckless endangerment of a child because police say she allowed her husband to babysit the children in her care.

Defense attorneys argued that the child porn allegedly found in the Burbine home should be thrown out because they say police did not follow proper search warrant procedure.

The prosecution countered that the search warrant was executed properly.

Marian Burbine returned home after court where she is under house arrest. John Burbine is still being held on $1 million cash bail. His trial set for December.
